What Consent Means in Canada
Under Canadian law, sexual consent must be freely and voluntarily given by each person involved. It cannot be assumed from silence, previous activity, or a pre-existing relationship. Consent is specific to each activity.
Consent Can Be Withdrawn
Canadian law is explicit: consent can be withdrawn at any time, for any reason, even if it was given earlier. Once a person withdraws consent, continuing the activity is a violation of that person's rights.
Intoxication and Consent
Alcohol and other substances affect a person's ability to give meaningful consent. Canadian courts have consistently held that a heavily intoxicated person is not legally capable of consenting.
Communicating About Consent
The clearest approach to consent is direct verbal communication. Asking questions like 'Is this okay?' removes ambiguity. This is not awkward โ it is respectful.
